1. Agreement to terms

By accessing or using AirTrack ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

These terms apply to all users of AirTrack, including HVAC business owners and their authorized team members.

2. Description of service

AirTrack is a software-as-a-service (SaaS) platform that helps HVAC companies manage maintenance agreements, track customer service schedules, and send automated email reminders. Features include:

  • Customer and maintenance agreement management
  • Automated email reminders via Resend
  • AI-generated email drafts via OpenAI
  • Service schedule calendar
  • Revenue opportunity tracking
  • CSV import and export

3. Subscriptions and billing

Plans

AirTrack offers the following subscription plans:

  • Starter — $49/month, up to 200 customers
  • Pro — $79/month, unlimited customers with AI email features

Billing

Subscriptions are billed monthly. Payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

4. Acceptable use

You agree not to use AirTrack to:

  • Send unsolicited commercial email (spam) to contacts not related to your HVAC business
  • Store or transmit unlawful, harassing, or abusive content
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Reverse engineer, copy, or resell the Service
  • Use the Service for any purpose other than managing your HVAC maintenance business

5. Your data

You own all customer data you enter into AirTrack. By using the Service, you grant us a limited license to store and process that data solely to provide the Service to you.

You are responsible for ensuring you have the right to store your customers' personal information and for complying with applicable privacy laws when sending them emails through our platform.

6. Availability and support

We aim to keep AirTrack available 24/7 but do not guarantee uninterrupted availability. We may perform maintenance that temporarily affects access. We provide support on a best-effort basis via email.

7. Limitation of liability

To the maximum extent permitted by law, AirTrack and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost revenue, lost data, or business interruption.

Our total liability to you for any claims arising from these terms or your use of the Service shall not exceed the amount you paid us in the three months preceding the claim.

8. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service, engage in fraudulent activity, or fail to pay your subscription fees. You may terminate your account at any time by contacting us.

10. Changes to terms

We may update these Terms of Service from time to time. We will notify you of significant changes by email. Your continued use of the Service after changes constitutes acceptance of the updated terms.

11. Governing law

These terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration rather than court proceedings, except where prohibited by law.
